Effective as of 10 July 2009
Parties to This Agreement are:
1) One World Trading-Service-Tourism Co., Ltd., in this Agreement is called “One World”.
2) Any person, agent, or company that directly or indirectly pays One World for services, in this Agreement is called “Traveler”.
Every Traveler must read and agree to these Terms and Conditions, prior to sending payment for One World services. Sending payment to One World constitutes acceptance of these Terms and Conditions by the Traveler.
Travel Package Quote:
When a Traveler requests a Travel Package Quote, One World will suggest an itinerary of dates, destinations, and a detailed explanation of the many special services One World will include.
Deposit Payment:
When the Traveler accepts the Travel Package Quote, a deposit in the amount of 50 % of the total Travel Package Quote is required. Then, One World will quickly begin making reservations and arranging special services for the Traveler.
Letter of Confirmation:
One World will send a Letter of Confirmation to the Traveler, by fax or e-mail, after the Deposit Payment is received and all reservations are completed. If, for any reason, One World is unable to complete the reservations within 10 days after receiving the Deposit Payment, One World will promptly refund the Deposit Payment and cancel the Travel Package.
Final Payment:
Final payment is due 30 days before the departure date. If final payment is not received 30 days before the departure date, One World may cancel the booking and keep the deposit payment. If One World agrees to sell a Travel Package less than 30 days before the departure date, full payment is required immediately.
Receipt / Voucher:
One World will send a Receipt / Voucher to the Traveler, by fax or e-mail, after all reservations are completed and the final payment is received.
Payment Methods:
All payments must be in US dollars or Euro. Payment can be sent to One World by bank wire transfer (T/T) or through Western Union Global Transfer. Any charges by the sending bank must be paid by the Travelers.
Immunization, Passport, Visa, & Traveler’s Insurance:
If required by the destination country(s), Traveler is responsible for arranging immunizations, getting a passport, obtaining a visa, and purchasing adequate Traveler’s insurance.
Refund of Unused Services:
No refunds or exchanges can be made for accommodations, meals, sightseeing tours, transportation, or any other services which are included in the Travel Package Quote but not utilized by the Traveler.
Cancellation of a Travel Package:
Deposit Payments are non-refundable. After the Final Payment has been made, if Traveler cancels a Travel Package, the charge for cancellation will be as follows:
Days prior to departure: Cancellation Fees as % of Travel Package Quote:

30 to 45 10%
15 to 29 40%
7 to 14 60%
Less than 7 100%
Changes to the Travel Package:
Every effort will be made to ensure that each tour follows the content of the Travel Package Quote. However, on occasion, conditions related to weather, failure of any means of transportation, strikes, acts of God, or situations beyond our control, may require revisions of the Travel Package. Any resulting additional expense will be payable by the Travelers. Any resulting savings will be refunded by One World to Travelers.
Right to Refuse Service:
One World reserves the right to refuse service to any Traveler if such person’s health, mental condition, physical infirmity, or general demeanor impedes the operation of the tour or the rights, welfare, or enjoyment of passengers. A refund of unused tour services is the limit of One World’s liability.
Modification of this Agreement:
One World may, from time to time and without notice, modify these Terms and Conditions. One World and Travelers agree to abide by the Terms and Conditions posted on the One World website, www.oneworldvn.com, at the time of initial payment.
Limit of Liability:
One World acts only as an agent for the Travelers in regard to transportation and all other travel related services as stated in the Travel Package Quote, assumes no responsibility nor liability in connection with the service of any train, bus, minibus, boat, aircraft, carriage, motor, or other conveyance which may be used either wholly or in part, in the performance of its duty to the passenger; neither will it be responsible for any act, error or omission, or for any personal injury, damage, loss, accident, delay or inconvenience which may be occasioned by reasons of any defect in any vehicle, or through any act, neglect or default of any company or person engaged in conveying the passenger or in carrying out the arrangement or execution of the tour. One World cannot be held liable for flight delays, cancellations, or missed connections, and are not liable for any expenses or resulting consequences. Should such problems occur, One World will endeavor to substitute a suitable arrangement of similar value. Any resulting additional expense will be payable by the Travelers. Any resulting savings will be refunded to Travelers. If Travelers use an agent to do business with One World, One World cannot be held liable for negligence, incompetence, misrepresentation, or malicious acts of that agent.
Jurisdiction and Attorney Fees:
In the event of any dispute arising from this agreement, and whether or not formal litigation is commenced to enforce the provisions of this agreement, the prevailing party in any such dispute shall be entitled to recover their reasonable attorney fees and costs in addition to any amounts owed under the terms of this agreement or recovered as damages resulting from breach of this agreement. The exclusive jurisdiction for litigation will be the courts of Vietnam, in Ho Chi Minh City.
One World Tourism will do its best efforts to avoid charges mentioned above, as far as providers will agree and administrative cost were not generated.
